To use the Services, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding agreement.
• Provide accurate and complete registration information.

We reserve the right to refuse service to any individual or organization at our sole discretion.

Users may create accounts to access platform features.

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• Restricting access to your account.
• All activities performed through your account.

You agree to immediately notify us of any unauthorized use of your account.

Sync My Studio shall not be liable for losses resulting from unauthorized access caused by your failure to secure your credentials.

Sync My Studio provides business management and workflow software for photographers, videographers, creative professionals, agencies, and related businesses.

Platform features may include:

• Dashboard Management
• Project Management
• Client Management
• Team Management
• AI Face Scan
• Music Library
• SOP Management
• Leads Finder
• Client Onboarding
• Final Gallery Delivery
• Communication Tools
• Reputation Management
• Additional features released in the future

We reserve the right to modify, discontinue, replace, restrict, or remove any feature at any time without liability.

Users retain full ownership of all content uploaded to the platform, including:

• Photos
• Videos
• Audio Files
• Documents
• Client Data
• Creative Assets
• Project Information
• Project files

Sync My Studio does not claim ownership of user content.

By uploading content, you grant Sync My Studio a limited, worldwide, non-exclusive license to host, process, store, transmit, display, and manage such content solely for providing the Services.

You represent and warrant that:

• You own or have the legal right to upload content.
• Your content does not violate intellectual property rights.
• Your content does not violate privacy rights.
• Your content complies with applicable laws.

You are solely responsible for all content uploaded through your account.

Sync My Studio may provide AI-powered facial recognition and face matching functionality.

Users acknowledge and agree that:

• Face matching results may not always be accurate.
• AI-generated results should be independently verified.
• Sync My Studio does not guarantee successful identification of individuals.
• Users are responsible for obtaining any necessary permissions or consents before processing third-party facial images.

User content processed through AI features will not be used to train public AI models without explicit consent.

Files may be stored using third-party infrastructure providers, including but not limited to cloud storage and content delivery networks.

Users acknowledge that:

• Sync My Studio is not a backup service.
• Users are solely responsible for maintaining their own backups.
• Deleted files may be permanently removed.
• Recovery of deleted content is not guaranteed.

Sync My Studio shall not be liable for lost, corrupted, inaccessible, deleted, or damaged files.

Account owners may authorize employees, freelancers, contractors, or team members to access projects and files.

The account owner is solely responsible for:

• Managing access permissions.
• Monitoring team activity.
• Actions performed by authorized users.

Sync My Studio shall not be responsible for misuse of data by individuals authorized by the account owner.

Certain Services require payment of subscription fees.

Available plans may include:

• Monthly Plans
• Annual Plans

All prices are subject to change at any time.

Changes to pricing will apply to future billing cycles.

Payments are processed through Razorpay and authorized payment providers.

Failure to pay subscription fees may result in:

• Restricted access
• Suspension
• Termination of services

ALL PAYMENTS ARE FINAL.

To the maximum extent permitted by applicable law:

• Subscription fees are non-refundable.
• Renewal payments are non-refundable.
• Setup fees are non-refundable.
• Service fees are non-refundable.

No refunds will be provided for:

• Partial usage.
• Failure to use the service.
• Account suspension due to violations.
• Feature changes.
• User dissatisfaction.

Users shall not:

• Upload illegal content.
• Upload malware, ransomware, viruses, or malicious code.
• Engage in harassment or abusive behavior.
• Infringe intellectual property rights.
• Distribute spam.
• Conduct fraudulent activities.
• Attempt unauthorized access.
• Reverse engineer the platform.
• Interfere with platform operations.
• Circumvent security measures.

Violation of these rules may result in immediate account suspension or termination.

All platform-related intellectual property remains the exclusive property of Sync My Studio, including:

• Software
• Source Code
• Platform Design
• Branding
• Logos
• Documentation
• Databases
• Proprietary Processes

Users may not:

• Copy
• Reproduce
• Modify
• Distribute
• Sell
• Lease
• Reverse Engineer

any part of the platform without prior written permission.

Users agree that Sync My Studio may send:

• Product updates
• Service notifications
• Feature announcements
• Marketing emails
• Promotional offers
• Newsletters

Users may opt out of promotional communications at any time.

Service-related communications may continue as necessary.

Sync My Studio may suspend, restrict, investigate, or terminate accounts at its sole discretion for:

• Non-payment
• Abuse
• Copyright infringement
• Illegal content
• Spamming
• Misuse of the platform
• Fraudulent activity
• Security threats
• Violations of these Terms

We may take such actions without prior notice where reasonably necessary.

The platform may integrate with third-party providers including storage providers, payment processors, content delivery networks, and communication services.

Sync My Studio is not responsible for:

• Third-party outages
• Third-party policies
• Third-party security incidents
• Third-party service interruptions

Use of third-party services is subject to their own terms and policies.

Google Calendar Integration

Sync My Studio provides an optional Google Calendar integration to help photographers, videographers, and creative studios manage their schedules and avoid double bookings.

When a user chooses to connect their Google Calendar account with Sync My Studio, the user authorizes Sync My Studio to access the calendar information required to provide the scheduling and booking functionality.

Purpose of Access

Sync My Studio accesses Google Calendar information only for the purpose of providing the scheduling and booking functionality requested by the user, including checking scheduling conflicts and availability.

The information may be used to:

• Check whether a photographer or videographer has an existing scheduled event during a requested booking time.
• Determine whether a proposed booking overlaps with an existing calendar event.
• Help prevent double bookings.
• Display relevant availability or scheduling information within Sync My Studio.
• Create, update, or remove calendar events on the connected calendar for bookings made or managed through Sync My Studio (including attaching Google Meet links where the user has enabled video meetings).
• Provide calendar and booking functionality requested by the user.

Google Calendar data will not be used for advertising, marketing profiling, selling user information, or any purpose unrelated to the Sync My Studio calendar and booking functionality.

Google Calendar Data We Access

Depending on the permissions authorized by the user, Sync My Studio may access information such as:

• Calendar event dates and times.
• Event availability (free/busy) information.
• Calendar identifiers required to access the connected calendar.
• Other calendar information strictly necessary to determine whether a booking conflicts with an existing scheduled event, or to manage booking events created through Sync My Studio.

Sync My Studio follows the principle of requesting only the minimum permissions necessary to provide the requested functionality.

No Sale or Unauthorized Sharing

Sync My Studio does not sell, rent, trade, or commercially distribute Google Calendar data.

Google Calendar data will not be shared with:

• Advertisers;
• Marketing companies;
• Data brokers;
• Information resellers; or
• Other third parties for their own independent commercial purposes.

Google Calendar data will only be processed as necessary to provide the calendar and booking functionality of Sync My Studio, maintain and secure the service, comply with applicable legal obligations, or as otherwise permitted under Google's applicable policies.

Any service providers that may process information on behalf of Sync My Studio are required to use such information only for the services they provide to Sync My Studio and are subject to appropriate confidentiality and security obligations.

Storage and Security

Sync My Studio takes reasonable technical and organizational measures to protect Google Calendar information against unauthorized access, disclosure, alteration, or destruction.

Access to Google Calendar information is restricted to authorized systems and personnel who require such access for the operation, maintenance, security, or support of Sync My Studio.

Google Calendar information is not used to build advertising profiles or for unrelated analytics or commercial purposes.

Data Retention

Sync My Studio retains Google Calendar-related information only for as long as reasonably necessary to provide the Google Calendar integration and related booking functionality.

When such information is no longer required for the purposes described in this section, Sync My Studio will delete or anonymize it where reasonably practicable, subject to applicable legal, security, fraud-prevention, and compliance requirements.

Disconnecting Google Calendar

Users may disconnect their Google Calendar account from Sync My Studio at any time.

After the integration is disconnected, Sync My Studio will no longer access the user's Google Calendar through the authorization previously granted by the user.

Users may also revoke Sync My Studio's access directly through their Google Account settings.

Account and Data Deletion

Users may request deletion of their Sync My Studio account and associated data by contacting Sync My Studio through the support contact information provided on our website. See our Data Deletion page for details.

Upon an eligible deletion request, Sync My Studio will delete applicable user data in accordance with our data-retention practices and applicable legal requirements.

Disconnecting Google Calendar and deleting a Sync My Studio account are separate actions. Users may revoke Google Calendar access independently through their Google Account settings.

Google API Services User Data Policy

Sync My Studio's access to and use of information obtained through Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.

Information obtained from Google APIs is used only to provide or improve user-facing features that are directly related to the functionality described above.

Sync My Studio does not use Google user data for advertising, targeted advertising, or any other purpose prohibited by Google's API Services User Data Policy.

User Authorization

The Google Calendar integration is optional. Users are required to explicitly authorize Sync My Studio to access their Google Calendar before any Google Calendar information is accessed.

Users may choose not to connect Google Calendar; however, certain scheduling and conflict-detection features may not be available without the integration.

Changes to Google Calendar Integration

Sync My Studio may modify or improve the Google Calendar integration from time to time. If any material change affects how Google user data is accessed, used, stored, or shared, the applicable privacy disclosures will be updated accordingly.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

SYNC MY STUDIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• AVAILABILITY

We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, Sync My Studio shall not be liable for:

• Loss of profits
• Business interruption
• Data loss
• Loss of goodwill
• Lost opportunities
• Indirect damages
• Incidental damages
• Consequential damages
• Special damages

You agree to defend, indemnify, and hold harmless Sync My Studio, its owners, directors, employees, affiliates, contractors, and representatives from any claims, damages, liabilities, costs, and expenses arising out of:

• User content.
• User misconduct.
• Violation of these Terms.
• Violation of intellectual property rights.
• Violation of applicable laws.
• Disputes between users and third parties.

Sync My Studio shall not be liable for delays, failures, or interruptions resulting from events beyond reasonable control, including:

• Natural disasters
• Floods
• Fires
• Earthquakes
• Government actions
• Internet outages
• Cyberattacks
• Power failures
• Labor disputes
• Third-party infrastructure failures

These Terms shall be governed by the laws of India.

Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Chandigarh, India.

Before initiating legal proceedings, both parties agree to attempt good-faith negotiations for at least thirty (30) days.

Sync My Studio may revise these Terms at any time.

Updated versions become effective upon publication on the platform.

Continued use of the Services after publication constitutes acceptance of the updated Terms.
